David Anthony

David Anthony has a national litigation practice representing companies in highly regulated industries, including consumer financial services companies. He has significant experience in class actions and complex individual lawsuits. He has significant litigation experience defending cases under the Fair Credit Reporting Act (FCRA), the Fair Debt Collection Practices Act (FDCPA), the Telephone Consumer Protection Act (TCPA) and numerous other federal and state consumer protection statutes, with particular expertise in matters that often involve companion government investigations.
He has served as lead counsel in more than 100 class action lawsuits and more than 1,500 individual lawsuits in courts across the country. David understands the outsized financial risks and high stakes associated with class-action lawsuits that impact how these cases are defended, tried and settled.

Kevin Bachman

He is a background check executive providing financial, strategic and operational solutions to owners and senior management of CRA’s and data providers. Kerstin Bagus

Kerstin is the Chief Knowledge Officer for NetForce Global where she uses her more than 30 years of screening experience to assist clients and their data subjects. She is a frequent PBSA presenter and has served in leadership positions with PBSA including Board participation and Committee leadership. Pamela Q. Devata

Pamela Devata is a Labor and Employment Partner at Seyfarth Shaw LLP in Chicago, IL. Pam leads Seyfarth’s nationwide Background Screening, Litigation and Compliance Team. She is a national authority and firm go-to for all issues related to the Fair Credit Reporting Act (FCRA), background screening compliance, use of criminal and credit history, and Electronic Signature issues as well online and manual employment applications. A nationally recognized employment counselor, Pam has participated in numerous interviews, speeches, webinars, and trainings to employers on the subject criminal history and credit checks. She has leveraged her niche area of expertise into a thriving class action practice.

She represents employers, resellers, and consumer reporting agencies of background information on compliance requirements under FCRA and related state laws, develops procedures for appropriately handling high-volume national hiring needs, and she regularly litigates these issues on a single-plaintiff and class-wide basis throughout the country.  Pam also testified before the EEOC at a Public Meeting regarding the use of credit checks in employment in Washington, D.C. Pam is also a certified Lean Six Sigma Yellow Belt and was formerly an adjunct professor of Legal Writing at Chicago-Kent College of Law.

Jackie Drziak

Jackie serves as Executive Vice President of All in Compliance, a firm that provides compliance outsource solutions to Credit Reporting Agencies.  In this capacity, she is responsible for all operations including marketing and service fulfillment. Nick Fishman, Partner, Morris Consulting Group A 20-year industry veteran, Nick Fishman co-founded EmployeeScreenIQ, a global leader in employment background checks and served as the company’s Chief Marketing Officer and Executive Vice President until the company was acquired by Sterling in 2015. He currently is an operating partner at Morris Consulting Group which helps CRA’s develop strategic plans with a primary focus on revenue optimization, product development, scalability and market positioning. He also serves as an expert witness on matters related to FCRA/EEOC litigation.

Cindy Hanson

Cindy Hanson is a partner in the Consumer Financial Services practice at Troutman Sanders and focuses her practice on class action defense. Cindy has handled hundreds of matters under the Fair Credit Reporting Act, including over two dozen class actions. Her practice includes the representation of consumer reporting agencies, entities who furnish information to consumer reporting agencies and employers who use background check information for employment purposes. In addition, she has significant experience representing companies defending class actions under consumer protection statutes and state common law.

Katie Hawkins

Nikki Holton is a Consultant working for the HR Global Investigations & Screening COE for ELI Lily and Company in Indianapolis, Indiana. She has over 30 years of experience in various facets of Human Resources but her concentration lies with managing Lilly’s background screening program for both their employee population and the contingent workforce for over 13 years. She has spoken at past PBSA conferences and is a member of the End-User Advisory Panel through the PBSA.

Kevin Horval

He has served in leadership roles with PBSA including Government Relations and the Access subcommittee. Rebecca Kuehn

Becki is a partner in the firm's Washington, DC office, where she chairs the Credit Reporting, Privacy, and Data Security Practice Group. Her practice focuses on consumer financial services and consumer protection matters. Becki counsels financial institutions, consumer reporting agencies, service providers, and others in complying with consumer financial laws and prohibitions against unfair, deceptive, or abusive trade practices. She is an experienced advocate and litigator, representing clients before federal and state agencies and the courts, particularly the Federal Trade Commission and Consumer Financial Protection Bureau, in investigations and other proceedings.

Carol Miaskoff
Associate Legal Counsel, EEOC
Carol R. Miaskoff is the Associate Legal Counsel of the Equal Employment Opportunity Commission (Commission or EEOC). As deputy director of the Office of Legal Counsel, she is responsible for managing development of the Commission regulations and guidance under the Americans with Disabilities Act, Title VII of the Civil Rights Act of 1964, the Age Discrimination in Employment Act, the Equal Pay Act, and the Genetic Information Nondiscrimination Act. She also provides legal advice to the Commission on a wide range of matters, and works with the Department of Justice to defend the Chair and the Commission in litigation when stakeholders challenge Commission rules, guidance, and actions in court. During her career at the EEOC, Ms. Miaskoff has supervised the development of proposed Commission policy on workplace harassment and final Commission guidance on retaliation and national origin discrimination.  She served as a member of the EEOC’s equal pay task force and speaks frequently to labor and employment groups about issues ranging from the use of big data in employment to psychiatric disabilities and the ADA. Ms. Miaskoff graduated from Harvard University and from the George Washington University Law School, with high honors. In the community, Ms. Miaskoff has been active in the Montgomery County, MD, Mental Health Advisory Committee, and guest lectures at a Georgetown University undergraduate class on Women and the Law. 

Montserrat Miller

Jennifer Mora

Jennifer Mora is a Senior Counsel at Seyfarth Shaw, LLP. Jennifer is a nationally recognized expert on employment-purposed background checks, and regularly advises employers and consumer reporting agencies on the intersection of federal and state background check laws, including the Fair Credit Reporting and state law equivalents, Title VII of the Civil Rights Act, state and local ban the box laws and state fair employment laws. Vince developed his pre-Wholesale Screening executive management skills in roles as president, vice president and general counsel, vice-president of sales, and director of business development and compliance. Vince has been an attorney and executive in the enterprise risk mitigation industry since 1998. He is a licensed attorney, is SHRM certified SHRM-SCP and PBSA certified FCRA Advanced, and is the former two-term Co-Chair of the PBSA Industry Practices Committee. Vince earned his Juris Doctorate degree from the University of Colorado School of Law and his Bachelor of Arts, magna cum laude, from Long Island University.

Lester Rosen

Lester S. Rosen is an attorney at law and CEO of Employment Screening Resources (www.ESRcheck.com ), an accredited national background screening company headquartered in California. He is the author of, The Safe Hiring Manual: The Complete Guide to Employment Screening Background Checks for Employers, Recruiters and Jobseekers (826 pages-Facts on Demand Press/3d Edition 2017), the first comprehensive book on employment screening.

He is also a consultant, writer and frequent presenter nationwide on pre-employment screening and safe hiring issues. His speaking appearances have included numerous national and statewide conferences and webinars. He has qualified and testified in court cases as an expert witness on issues surrounding hiring and due diligence. Mr. Rosen was the chairperson of the steering committee that founded the Professional Background Screening Association (PBSA), and served as the first co-chairman in 2004. He received the PBSA Lifetime Achievement award in 2019.

Brent Smoyer

Brent Smoyer, of Smoyer Government Affairs, serves as the NAPBS State Government Relations and Grassroots Director. Smoyer’s combined 15 years of experience includes work on federal, state and local political campaigns, state level policy craft as a legislative aide and legal counsel in both the Iowa and Nebraska Legislatures, and (as he calls it) “time served” in elected office as a County Commissioner for Lancaster County, Neb. While he jokingly refers to himself as a “recovering bureaucrat”, it is that experience he uses to help build relationships, craft quality policy, and dodge pitfalls often present in state government. Mark Sward
